Kesha’s Court Case Recap

As of Friday, Feb. 19, Kesha’s ongoing legal battle against her alleged abuser, music producer Dr. Luke, continued. Justice Shirley Kornreich denied Kesha’s request to have her six-album contract with Dr. Luke terminated. After the ruling, dozens of celebrities sided with Kesha, trending the hashtag #FreeKesha on social media sites. The actual trial against Dr. Luke in which Kesha’s rape and abuse allegations against him will not begin until later in 2017. Kesha will be charging Dr. Luke on several counts, including sexual assault and battery; sexual harassment; gender violence; civil harassment; violation of California’s unfair business laws; intentional infliction of emotional distress; negligent infliction of emotional distress; and negligent retention and supervision. It wasn’t until Monday, Feb. 22, that Dr. Luke broke his silence with multiple Twitter posts.

“I didn’t rape Kesha and I have never had sex with her,” said Dr. Luke in one of his Twitter posts. Despite this, Dr. Luke’s past Twitter posts may lead to his downfall. He reportedly tweeted a picture of Kesha sleeping with the caption, “damn my artists work hard!!!!!!!” Dr. Luke recently took this picture down amidst Kesha’s allegations. Dr. Luke has repeatedly denied these allegations.

“Of course any sane person is against rape and sexual assault but everybody who is commenting is doing so without knowledge or facts.” Tweeted Dr. Luke, “Imagine if you or somebody you loved was publicly accused of a rape you knew they didn’t do. Imagine that. I have three sisters, a daughter, and a son with my girlfriend, and a feminist mom who raised me right. Kesha and I made a lot of songs together and it was often good but there were creative differences at times. It’s sad that she would turn a contract negotiation into something so horrendous and untrue.”

Before readers make their own assumptions and decisions, it’s important to know the whole story. So let’s start from the beginning.

In 2005 Dr. Luke discovered Kesha, who was 18 years old at the time, and signed her to a record deal on is label, Kemosabe Entertainment. According her lawsuit, Dr. Luke dazzled Kesha with the promise of fame and fortune and lured her away from her home and family in Nashville to Los Angeles.

It wasn’t until 2008 that the general public actually heard Kesha and when they did they heard her vocals in Flo Rida’s song “Right Round” which Dr. Luke never credited her for. Kesha claims that she has never received compensation for lending her vocals to the song.  In 2009 Dr. Luke took the picture of Kesha sleeping and posted it on Twitter. In 2010 Kesha released her first album, “Animal,” under Dr. Luke’s label. In 2012 she released her album, “Warrior.” Kesha showed signs of possible abuse in 2014 when she checked into rehab for her eating disorder. Her mother later said that Kesha almost died from low blood pressure and sodium. Kesha and her mother later claimed that Kesha’s eating disorder was partially caused by Dr. Luke, they reported that he once called Kesha a “fat f**king refrigerator.”

In October of 2014 Kesha filed the lawsuit against Dr. Luke, stating that he has abused her for almost ten years. The lawsuit states that “Dr. Luke abused Ms. Serbert in order to destroy her self-confidence, self-image and self-worth so that he could maintain complete control over her life and career.” The accusations against Dr. Luke are as follows: He forced Kesha to snort an illegal drug before a flight and then raped her while she was intoxicated and drugged. He forced her to drink with him and then gave her what he called “sober pills.” Kesha claims that she woke up the next morning naked in his bed and sore with no idea how she got there. Dr. Luke told Kesha “that if he ever mentioned the rape to anyone, he would shut her career down and otherwise destroy not only her life but her entire family’s lives as well.” Dr. Luke physically threatened Kesha and so she ran away from his home and ran barefoot down the Pacific Coast Highway and hid in the nearby mountains.

In response to Kesha’s lawsuit, Dr. Luke filed a countersuit saying that Kesha and her mother were trying to extort him so that Kesha could get out of her contract. Not all of the facts are known yet and Kesha’s trial is set to continue in late 2017.
